Layoffs and Plant Closings

If you ever have had a work-related injury or disease you may be eligible for workers’ compensation benefits if you are laid off or if your employer goes out of business.

If your plant closes or if you are laid off while on light duty because of a work injury you are entitled to reinstatement of your workers’ compensation wage loss benefits in many cases.

Your employer will almost never inform you of this right to benefits. Moreover, in certain cases, even those who are working on regular duty at the time of layoff may be eligible to claim wage loss benefits.

We recommend that anyone who ever has had a work injury or disease consult with an experienced workers’ compensation lawyer after losing their job for any reason, including layoffs and plant closings.
